Mining Permit

If you want to conduct mining operations, we will help you to obtain a mining permit from the Department of Mineral Resources (DMR).

Prospecting Right
If you want to apply for a prospecting right you must lodge the application online.
Water use registration
All water users need to register with the Department of Water Affairs.

No person is allowed to mine without a mining permit.

Mining permits are not transferable. They are aimed at controlling prospecting and mining, having regard to considerations for health and safety, environmental management and the responsible extraction of minerals.

A mining permit is valid for the period specified on the permit, but may not exceed two years. It may however be renewed for three more periods of no more than a year each.

A mining permit may only be issued if:

  • the mineral in question can be mined optimally for two years
  • the mining area does not exceed 1,5 ha.

A mining right may not exceed a period of 30 years and mining rights are granted if:

  • the mineral can be mined optimally
  • you have the funds and expertise to conduct the proposed mining operation optimally
  • the financing plan is compatible with the intended mining operation and for the duration thereof
  • no unacceptable pollution or damage to the environment will occur as a result of the mining operation
  • you have made financial and other provisions for the prescribed social and labour plan
  • you are not contravening the Mineral and Petroleum Resources Development Act, 2002 (Act 28 of 2002) (MPRDA)
  • the operation is in line with the Mining Charter.

Prospecting Right

If you want to apply for a prospecting right you must lodge the application online.

A prospecting right is a permit which allows you or your company to survey or investigate an area of land for the purpose of identifying an actual or probable mineral deposit.

A prospecting right is valid for five years. After the expiry of the five years you may request renewal of the prospecting right for a period of no longer than three years.

 

The prospecting right will be granted if:

  • you have access to financial resources and expertise to conduct the proposed prospecting operation optimally
  • you have a financing plan that is compatible with the intended prospecting operation and for the duration thereof
  • you are able to comply with the Mine Health and Safety 1996 (Act 29 of 1996)
  • you are not contravening the Mineral and Petroleum Resources Development Act, 2002 (Act 28 of 2002)
  • no other person holds a prospecting right, mining right, mining permit or retention permit for the same mineral and land
  • no unacceptable pollution or damage to the environment will occur as a result of the prospecting operation.

Register for water use

All water users need to register with the Department of Water Affairs. You must register for water use if you do not receive water from a service provider, local authority, water board, irrigation board, government water scheme or other bulk supplier and are using water for:

A mining permit may only be issued if:

  • irrigation
  • mining purposes
  • industrial use
  • feedlots
  • in terms of a General Authorisation.

 

In future, when water users are required to apply for licences, those who did not register will lower their chances of getting a licence to use water.
